MI Supreme Court Denies Alpena Township Water Appeal

The Michigan Supreme Court recently issued an order denying an application submitted by the Charter Township of Alpena seeking a leave to appeal the March 17th, 2020 judgment of the Court of Appeals regarding the ongoing water and sewer rate litigation with the City of Alpena.

The courts reasoning was that they are not persuaded that the questions presented should be reviewed by them.

The water - sewer issue has been an ongoing topic for years. When the township refused to pay a wholesale rate increase by the city in 2014, the city filed suit, and the township put additional charges from their customers into an escrow account. The escrow account has around two million dollars in it.

In a joint letter released late last year, Township and City officials say they are working together with the hope of resolving the issue and ending the litigation.
